Trip report: Google and YouTube in Iraq

Earlier this month, a small team from Google and YouTube spent a week in Iraq on a trip arranged by the Department of Defense’s Task Force for Business and Stability Operations (TFBSO). Our goals were to explore opportunities for Google in Iraq, to understand the landscape of Internet access and connectivity in the country during this critical transition period and to bring top-voted questions from YouTube to Iraqi leaders in a series of interviews. We met with students, private sector companies, NGOs and Iraqi leadership in the Kurdish city of Erbil in the north, and in Baghdad.

Regardless of your feelings about the Iraq War, it’s immediately evident upon arrival just how completely the country missed the Internet boom during Saddam Hussein’s regime. Internet penetration rates in Iraq are among the lowest in the Middle East—somewhere between one and eight percent. Only 15 percent of Iraqis say they use the web, and the largest percentage of them live in Baghdad. There are no commercial data centers in Iraq and much more fiber connectivity is needed to meet consumer needs. Most connections are via satellite, and those who do have connections pay dearly for it—we heard estimates of up to $150 U.S. dollars per month for a 512kb connection. To incentivize and enable private companies to lay more fiber in Iraq, a complex set of roadblocks must be addressed—from security concerns to regulatory frameworks to licensing structures. As the country is still struggling to form a government more than seven months after its last election, much of this progress has been stalled.

There are signs of progress, however. Mobile penetration has skyrocketed in Iraq in the past seven years, from effectively zero percent in 2003 to over 70% today. And the Iraqi people are highly educated. We met with dozens of computer science students at Salahaddin University in Erbil and at Baghdad University, and though they lack equipment and resources, they’re highly motivated to innovate and believe the web is a critical component of their economy’s future.

Many young people in Iraq and around the world submitted questions in Arabic and English for three interviews we conducted in partnership with Middle Eastern news agency Al Arabiya. Google Translate enabled anyone to vote on their favorite questions regardless of language, and we brought the top five questions to current Iraqi Prime Minister Nouri al-Maliki, the Prime Minister of the Kurdish Regional Government in Erbil, Dr. Barham Salih and Iraqi politician and once the interim Prime Minister of Iraq, Ayad Allawi. The Iraqis we met consistently expressed their desire for increased access to the web and for more access to content and tools in both Kurdish and Arabic. We believe access to information and high-speed connectivity to the cloud will be key to the future of the country. The power of the web to change people’s lives grows the further one gets from Silicon Valley, and we look forward to continuing our work with companies, governments and citizens in Iraq and other countries in transition.

Creating stronger privacy controls inside Google

In May we announced that we had mistakenly collected unencrypted WiFi payload data (information sent over networks) using our Street View cars. We work hard at Google to earn your trust, and we’re acutely aware that we failed badly here. So we’ve spent the past several months looking at how to strengthen our internal privacy and security practices, as well as talking to external regulators globally about possible improvements to our policies. Here’s a summary of the changes we’re now making.
  • First, people: we have appointed Alma Whitten as our director of privacy across both engineering and product management. Her focus will be to ensure that we build effective privacy controls into our products and internal practices. Alma is an internationally recognized expert in the computer science field of privacy and security. She has been our engineering lead on privacy for the last two years, and we will significantly increase the number of engineers and product managers working with her in this new role.

  • Second, training: All our employees already receive orientation training on Google’s privacy principles and are required to sign Google’s Code of Conduct, which includes sections on privacy and the protection of user data. However, to ensure we do an even better job, we’re enhancing our core training for engineers and other important groups (such as product management and legal) with a particular focus on the responsible collection, use and handling of data. In addition, starting in December, all our employees will also be required to undertake a new information security awareness program, which will include clear guidance on both security and privacy.

  • Third, compliance: While we’ve made important changes to our internal compliance procedures in the last few years, we need to make further changes to reflect the fact that we are now a larger company. So we’re adding a new process to our existing review system, in which every engineering project leader will be required to maintain a privacy design document for each initiative they are working on. This document will record how user data is handled and will be reviewed regularly by managers, as well as by an independent internal audit team.
We believe these changes will significantly improve our internal practices (though no system can of course entirely eliminate human error), and we look forward to seeing the innovative new security and privacy features that Alma and her team develop. That said, we’ll be constantly on the lookout for additional improvements to our procedures as Google grows, and as we branch out into new fields of computer science.

Finally, I would like to take this opportunity to update one point in my May blog post. When I wrote it, no one inside Google had analyzed in detail the data we had mistakenly collected, so we did not know for sure what the disks contained. Since then a number of external regulators have inspected the data as part of their investigations (seven of which have now been concluded). It’s clear from those inspections that while most of the data is fragmentary, in some instances entire emails and URLs were captured, as well as passwords. We want to delete this data as soon as possible, and I would like to apologize again for the fact that we collected it in the first place. We are mortified by what happened, but confident that these changes to our processes and structure will significantly improve our internal privacy and security practices for the benefit of all our users.

Taking rogue pharmacies to court

We work very hard to make sure that ads shown on Google provide useful information for our users. But sometimes we need to take action against ads that violate our policies, as when we block malware ads, or when we filed suit last year against “Google Money” scammers. This is especially true when it comes to advertising for products such as pharmaceuticals, which can be dangerous without the right prescription.

Like many online services, we have struggled with this problem for years. It’s been an ongoing, escalating cat-and-mouse game—as we and others build new safeguards and guidelines, rogue online pharmacies always try new tactics to get around those protections and illegally sell drugs on the web. In recent years, we have noticed a marked increase in the number of rogue pharmacies, as well an increasing sophistication in their methods. This has meant that despite our best efforts—from extensive verification procedures, to automated keyword blocking, to changing our ads policies—a small percentage of pharma ads from these rogue companies is still appearing on Google.

So this morning we filed a civil lawsuit in federal court against advertisers we believe have deliberately broken our rules. Litigation of this kind should act as a serious deterrent to anyone thinking about circumventing our policies to advertise illegally on Google. As we identify additional bad actors, we will add them to the lawsuit. Rogue pharmacies are bad for our users, for legitimate online pharmacies and for the entire e-commerce industry—so we are going to keep investing time and money to stop these kinds of harmful practices.

That’s why, in partnership with the Arabic-language television network, Al Arabiya, we’re launching “Iraq Looks Forward,” a series of interviews on YouTube in which Iraqi leaders answer your questions about the future of the country. Tools to visualize access to information

When Google’s services are blocked or filtered, we can’t serve our users effectively. That’s why we act every day to maximize free expression and access to information. To promote transparency around this flow of information, we’ve built an interactive online Transparency Report with tools that allow people to see where governments are demanding that we remove content and where Google services are being blocked. We believe that this kind of transparency can be a deterrent to censorship.

Like all companies, Google’s services occasionally experience traffic disruptions. Our new traffic tracking tool helps us and others track whether these interruptions are related to mechanical outages or are government-induced. Each traffic graph shows historic traffic patterns for a given country and service. Graphs are updated as data is collected, then normalized and scaled in units of 0 to 100. This new tool—which is global and includes China—will replace the Mainland China service availability chart, which showed product access for China alone. By showing outages, the traffic graphs visualize disruptions in the free flow of information, whether it's a government blocking information or a cable being cut. For example, the graphs show that YouTube has been inaccessible in Iran since June 12, 2009, following the disputed presidential election.


In April we also created a website that shows the number of government inquiries for information about users and requests for Google to take down or censor content. Today we’re updating this interactive Government Requests map with data from the first six months of 2010. We’ve also updated our analysis of the trends we saw across the data over the past six months. The new data for 2010 now includes the number of individual items asked to be removed, per country (for example, there may be many URLs per a single request.) You can learn more about trends in the data here. We view this as a concrete step that, we hope, will encourage both companies and governments to be similarly transparent.

Free expression is one of our core values. We believe that more information means more choice, more freedom and ultimately more power for the individual. Free expression is, of course, also at the heart of Google’s business. Our products are specifically designed to help people create, communicate, share opinions and find information across the globe. We hope this step toward greater transparency—and these tools—will help in ongoing discussions about the free flow of information.

How would you advance online free expression?

There seems to be no hotter topic for discussion among Internet watchers these days than concerns over online free expression -- from the role of bloggers in advancing democratic movements, to sophisticated government censorship, to debates over how best to balance transparency with national security concerns. YouTube, Google and the Central European University will make our own contribution to the conversation at a major international conference we’re hosting in Budapest from September 20-22. We've invited grassroots activists, bloggers and vloggers from five continents, as well as representatives from NGOs, academia, industry and government to begin a long-term discussion about these issues and to form international working groups to promote practical change.

But a conversation about online free expression would be nothing without contributions from you. From election protests to government whistleblowing to grassroots advocacy, we’ve seen YouTube users upload, watch and share stories that would’ve never received global attention before the Internet era. That's why we're inviting you to submit your own video that answers this question:

"What's the biggest barrier to free expression on the Internet, and what would you do to overcome it?"

Facts about our network neutrality policy proposal

Over the past few days there’s been a lot of discussion surrounding our announcement of a policy proposal on network neutrality we put together with Verizon. On balance, we believe this proposal represents real progress on what has become a very contentious issue, and we think it could help move the network neutrality debate forward constructively.

We don’t expect everyone to agree with every aspect of our proposal, but there has been a number of inaccuracies about it, and we do want to separate fact from fiction.

MYTH: Google has “sold out” on network neutrality.

FACT: Google has been the leading corporate voice on the issue of network neutrality over the past five years. No other company is working as tirelessly for an open Internet.

But given political realities, this particular issue has been intractable in Washington for several years now. At this time there are no enforceable protections – at the Federal Communications Commission or anywhere else – against even the worst forms of carrier discrimination against Internet traffic.

With that in mind, we decided to partner with a major broadband provider on the best policy solution we could devise together. We’re not saying this solution is perfect, but we believe that a proposal that locks in key enforceable protections for consumers is preferable to no protection at all.

MYTH: This proposal represents a step backwards for the open Internet.

FACT: If adopted, this proposal would for the first time give the FCC the ability to preserve the open Internet through enforceable rules on broadband providers. At the same time, the FCC would be prohibited from imposing regulations on the Internet itself.

Here are some of the tangible benefits in our joint legislative proposal:
  • Newly enforceable FCC standards
  • Prohibitions against blocking or degrading wireline Internet traffic
  • Prohibition against discriminating against wireline Internet traffic in ways that harm users or competition
  • Presumption against all forms of prioritizing wireline Internet traffic
  • Full transparency across wireline and wireless broadband platforms
  • Clear FCC authority to adjudicate user complaints, and impose injunctions and fines against bad actors
Verizon has agreed to voluntarily abide by these same requirements going forward – another first for a major communications provider. We hope this action will convince other broadband companies to follow suit.

MYTH: This proposal would eliminate network neutrality over wireless.

FACT: It’s true that Google previously has advocated for certain openness safeguards to be applied in a similar fashion to what would be applied to wireline services. However, in the spirit of compromise, we have agreed to a proposal that allows this market to remain free from regulation for now, while Congress keeps a watchful eye.

Why? First, the wireless market is more competitive than the wireline market, given that consumers typically have more than just two providers to choose from. Second, because wireless networks employ airwaves, rather than wires, and share constrained capacity among many users, these carriers need to manage their networks more actively. Third, network and device openness is now beginning to take off as a significant business model in this space.

In our proposal, we agreed that the best first step is for wireless providers to be fully transparent with users about how network traffic is managed to avoid congestion, or prioritized for certain applications and content. Our proposal also asks the Federal government to monitor and report regularly on the state of the wireless broadband market. Importantly, Congress would always have the ability to step in and impose new safeguards on wireless broadband providers to protect consumers’ interests.

It’s also important to keep in mind that the future of wireless broadband increasingly will be found in the advanced, 4th generation (4G) networks now being constructed. Verizon will begin rolling out its 4G network this fall under openness license conditions that Google helped persuade the FCC to adopt. Clearwire is already providing 4G service in some markets, operating under a unique wholesale/openness business model. So consumers across the country are beginning to experience open Internet wireless platforms, which we hope will be enhanced and encouraged by our transparency proposal.

MYTH: This proposal will allow broadband providers to “cannibalize” the public Internet.

FACT: Another aspect of the joint proposal would allow broadband providers to offer certain specialized services to customers, services which are not part of the Internet. So, for example, broadband providers could offer a special gaming channel, or a more secure banking service, or a home health monitoring capability – so long as such offerings are separate and apart from the public Internet. Some broadband providers already offer these types of services today. The chief challenge is to let consumers benefit from these non-Internet services, without allowing them to impede on the Internet itself.

We have a number of key protections in the proposal to protect the public Internet:
  • First, the broadband provider must fully comply with the consumer protection and nondiscrimination standards governing its Internet access service before it could pursue any of these other online service opportunities.
  • Second, these services must be “distinguishable in purpose and scope” from Internet access, so that they cannot over time supplant the best effort Internet.
  • Third, the FCC retains its full capacity to monitor these various service offerings, and to intervene where necessary to ensure that robust, unfettered broadband capacity is allocated to Internet access.
So we believe there would be more than adequate tools in place to help guard against the “cannibalization” of the public Internet.

MYTH: Google is working with Verizon on this because of Android.

FACT: This is a policy proposal – not a business deal. Of course, Google has a close business relationship with Verizon, but ultimately this proposal has nothing to do with Android. Folks certainly should not be surprised by the announcement of this proposal, given our prior public policy work with Verizon on network neutrality, going back to our October 2009 blog post, our January 2010 joint FCC filing, and our April 2010 op-ed.

MYTH: Two corporations legislating the future of the Internet.

FACT: Our two companies are proposing a legislative framework to the Congress for its consideration. We hope all stakeholders will weigh in and help shape the framework to move us all forward. We’re not so presumptuous to think that any two businesses could – or should – decide the future of this issue. We’re simply trying to offer a proposal to help resolve a debate which has largely stagnated after five years.

It’s up to Congress, the FCC, other policymakers – and the American public – to take it from here. Whether you favor our proposal or not, we urge you to take your views directly to your Senators and Representatives in Washington.

We hope this helps address some of the inaccuracies that have appeared about our proposal. We’ll provide updates as the situation continues to develop.

An update on China

Ever since we launched Google.cn, our search engine for mainland Chinese users, we have done our best to increase access to information while abiding by Chinese law. This has not always been an easy balance to strike, especially since our January announcement that we were no longer willing to censor results on Google.cn.

We currently automatically redirect everyone using Google.cn to Google.com.hk, our Hong Kong search engine. This redirect, which offers unfiltered search in simplified Chinese, has been working well for our users and for Google. However, it’s clear from conversations we have had with Chinese government officials that they find the redirect unacceptable—and that if we continue redirecting users our Internet Content Provider license will not be renewed (it’s up for renewal on June 30). Without an ICP license, we can’t operate a commercial website like Google.cn—so Google would effectively go dark in China.

That’s a prospect dreaded by many of our Chinese users, who have been vocal about their desire to keep Google.cn alive. We have therefore been looking at possible alternatives, and instead of automatically redirecting all our users, we have started taking a small percentage of them to a landing page on Google.cn that links to Google.com.hk—where users can conduct web search or continue to use Google.cn services like music and text translate, which we can provide locally without filtering. This approach ensures we stay true to our commitment not to censor our results on Google.cn and gives users access to all of our services from one page.

Over the next few days we’ll end the redirect entirely, taking all our Chinese users to our new landing page—and today we re-submitted our ICP license renewal application based on this approach.

As a company we aspire to make information available to users everywhere, including China. It’s why we have worked so hard to keep Google.cn alive, as well as to continue our research and development work in China. This new approach is consistent with our commitment not to self censor and, we believe, with local law. We are therefore hopeful that our license will be renewed on this basis so we can continue to offer our Chinese users services via Google.cn.

YouTube wins case against Viacom

Today, the court granted our motion for summary judgment in Viacom’s lawsuit with YouTube. This means that the court has decided that YouTube is protected by the safe harbor of the Digital Millennium Copyright Act (DMCA) against claims of copyright infringement. The decision follows established judicial consensus that online services like YouTube are protected when they work cooperatively with copyright holders to help them manage their rights online.

This is an important victory not just for us, but also for the billions of people around the world who use the web to communicate and share experiences with each other. We’re excited about this decision and look forward to renewing our focus on supporting the incredible variety of ideas and expression that billions of people post and watch on YouTube every day around the world.

UPDATE 2:12PM: This decision also applies to other parties to the lawsuit, including the Premier League.

The power of human rights video

A year ago this weekend, Tehran erupted in protest at the disputed results of Iran’s tenth presidential election. In the severe government crackdown that followed, documented on cameras and uploaded by citizens to YouTube, no moment has been seen more than the death of Neda Agha Soltan, a young musician whose brutal killing by a sniper became the rallying cry for Iran’s opposition Green Movement. The anonymous videos of her death even won the prestigious George Polk prize for journalism last year.

How has video become such an important part of human rights advocacy worldwide?  In the past, we mainly saw these kinds of images in the nightly news or in documentaries - and even then only occasionally. But now that access to the Internet is much more widespread (even in many developing countries), and billions worldwide have access to ever more powerful cellphones and digital cameras, we encounter human rights images much more directly - on YouTube, in Google searches, in Facebook feeds, through links shared on Twitter.

Working with AdMob to move mobile advertising forward

Today, the Federal Trade Commission cleared our acquisition of AdMob, a mobile advertising start up. We’re excited to work with Omar Hamoui and his talented team at AdMob to develop new mobile advertising solutions for marketers, mobile app developers and mobile publishers.

The decision is great news for the mobile advertising ecosystem as a whole. This was reflected in the widespread industry support for our acquisition.

Throughout the FTC’s review process, it’s been clear that mobile advertising is growing rapidly.

As mobile phone usage increases, growth in mobile advertising is only going to accelerate. This benefits mobile developers and publishers who will get better advertising solutions, marketers who will find new ways to reach consumers, and users who will get better ads and more free content.

We’re very excited about the possibilities in this field. As an immediate matter, we’re now moving to close this acquisition in coming weeks. We’ll then start work right away on bringing AdMob’s and Google’s teams and products together. This industry is moving fast, and we’re excited to be part of the race!

Honoring those who give voice to the silenced

It's said that change comes through the concerted efforts of small groups of people who dream of better times ahead. And then do something about it.

Today in Santiago, Chile, Google and the group Global Voices recognized three groups from around the world who are fighting for free expression online from Africa to Asia with the first "Breaking Borders" awards. These awards, supported by Thomson Reuters, are meant to honor those who are using the Internet to give voice to those once silenced, make the activities of governments more transparent, and standing up for the rights of dissidents.


The awards — given today at the Global Voices Summit where Internet activists from 60 countries have gathered — were originally announced November 3, 2009, when Google and others marked the 20th anniversary of the fall of the Berlin Wall, with the aim of celebrating how the Internet has become a vital ally in worldwide efforts to advance freedom and political change. This is particularly true at a time when dissidents, journalists and bloggers remain under severe pressure in the online and offline worlds.

An international jury of experts reviewed nominations from around the world and chose the awardees in three categories: advocacy, technology and policy. Each of the groups honored will receive a $10,000 grant to further their work. The winners are:

Kubatana.net (advocacy)
An online community for Zimbabwean activists, Kubatana uses the Internet, email, SMS, blogs and print materials to disseminate information to the general public. Cited for its extraordinary contributions while operating under in a tense and dangerous political atmosphere, Kubatana's contributions also include an online library of more than 16,000 human rights and civic reports together with a directory listing over 240 NGOs. Beyond its significance as a resource for information on Zimbabwe, Kubatana has also developed Freedom Fone, innovative software that marries the mobile phone to audio voice menus and SMS to give citizens new ways to communicate with one another.

BOSCO - Uganda

BOSCO was cited for its tremendously effective and creative use of long-exisiting technology to foster social and economic development and peace building in rural communities of northern Uganda. Launched in April 2007, BOSCO began as a solar powered, long-range wireless computer network covering locations in former Internally Displaced Persons camps across the Gulu and Amuru districts. Low power PCs and VoIP phones were installed in schools, health centers and parish offices, bringing Internet, phone and Intranet connectivity to remote areas. BOSCO's long-term vision is to build collaborative, web-based networks. Today it focuses on developing and facilitating Web 2.0 training, online digital ethnography and collaborative online communication mediums between Internet sites.

An independent, not-for-profit media agency, the PCIJ was founded by nine Filipino journalists in 1989 — with borrowed office space, an old-DOS-based computer, a second-hand electric typewriter, and office furniture bought from a thrift shop — to promote the values of investigative reporting in fostering good governance, freedom of expression, and the people's right to know. In 20 years, the PCIJ has produced 500 investigative reports, two dozen books on journalism and governance, five full-length films and dozens of video documentaries. It has conducted a hundred training seminars for journalists in the Philippines and Southeast Asia, and won over 120 national and international awards. The PCIJ maintains a multimedia website, an institutional blog; a database site on politics and governance; and institutional accounts on Twitter and YouTube.

Greater transparency around government requests

Article 19 of the Universal Declaration on Human Rights states that "everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers." Written in 1948, the principle applies aptly to today's Internet -- one of the most important means of free expression in the world. Yet government censorship of the web is growing rapidly: from the outright blocking and filtering of sites, to court orders limiting access to information and legislation forcing companies to self-censor content.

So it's no surprise that Google, like other technology and telecommunications companies, regularly receives demands from government agencies to remove content from our services. Of course many of these requests are entirely legitimate, such as requests for the removal of child pornography. We also regularly receive requests from law enforcement agencies to hand over private user data. Again, the vast majority of these requests are valid and the information needed is for legitimate criminal investigations. However, data about these activities historically has not been broadly available. We believe that greater transparency will lead to less censorship.

We are today launching a new Government Requests tool to give people information about the requests for user data or content removal we receive from government agencies around the world. For this launch, we are using data from July-December, 2009, and we plan to update the data in 6-month increments. Read this post to learn more about our principles surrounding free expression and controversial content on the web.

We already try to be as transparent as legally possible with respect to requests. Whenever we can, we notify users about requests that may affect them personally. If we remove content in search results, we display a message to users. The numbers we are sharing today take this transparency a step further and reflect the total number of requests we have received broken down by jurisdiction. We are also sharing the number of these content removal requests that we do not comply with, and while we cannot yet provide more detail about our compliance with user data requests in a useful way, we intend to do so in the future.

As part of our commitment to the Global Network Initiative, we have already agreed to principles and practices that govern privacy and free expression. In the spirit of these principles, we hope this tool will shine some light on the scale and scope of government requests for censorship and data around the globe. We also hope that this is just the first step toward increased transparency about these actions across the technology and communications industries.

Controversial content and free expression on the web: a refresher

Two and a half years ago, we outlined our approach to removing content from Google products and services. Our process hasn’t changed since then, but our recent decision to stop censoring search on Google.cn has raised new questions about when we remove content, and how we respond to censorship demands by governments. So we figured it was time for a refresher.

Censorship of the web is a growing problem. According to the Open Net Initiative, the number of governments that censor has grown from about four in 2002 to over 40 today. In fact, some governments are now blocking content before it even reaches their citizens. Even benign intentions can result in the specter of real censorship. Repressive regimes are building firewalls and cracking down on dissent online -- dealing harshly with anyone who breaks the rules.

Increased government censorship of the web is undoubtedly driven by the fact that record numbers of people now have access to the Internet, and that they are creating more content than ever before. For example, over 24 hours of video are uploaded to YouTube every minute of every day. This creates big challenges for governments used to controlling traditional print and broadcast media. While everyone agrees that there are limits to what information should be available online -- for example child pornography -- many of the new government restrictions we are seeing today not only strike at the heart of an open Internet but also violate Article 19 of the Universal Declaration of Human Rights, which states that: “Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.”

We see these attempts at control in many ways. China is the most polarizing example, but it is not the only one. Google products -- from search and Blogger to YouTube and Google Docs -- have been blocked in 25 of the 100 countries where we offer our services. In addition, we regularly receive government requests to restrict or remove content from our properties. When we receive those requests, we examine them to closely to ensure they comply with the law, and if we think they’re overly broad, we attempt to narrow them down. Where possible, we are also transparent with our users about what content we have been required to block or remove so they understand that they may not be getting the full picture.

On our own services, we deal with controversial content in different ways, depending on the product. As a starting point, we distinguish between search (where we are simply linking to other web pages), the content we host, and ads. In a nutshell, here is our approach:

Search is the least restrictive of all our services, because search results are a reflection of the content of the web. We do not remove content from search globally except in narrow circumstances, like child pornography, certain links to copyrighted material, spam, malware, and results that contain sensitive personal information like credit card numbers. Specifically, we don’t want to engage in political censorship. This is especially true in countries like China and Vietnam that do not have democratic processes through which citizens can challenge censorship mandates. We carefully evaluate whether or not to establish a physical presence in countries where political censorship is likely to happen.

Some democratically-elected governments in Europe and elsewhere do have national laws that prohibit certain types of content. Our policy is to comply with the laws of these democratic governments -- for example, those that make pro-Nazi material illegal in Germany and France -- and remove search results from only our local search engine (for example, www.google.de in Germany). We also comply with youth protection laws in countries like Germany by removing links to certain material that is deemed inappropriate for children or by enabling Safe Search by default, as we do in Korea. Whenever we do remove content, we display a message for our users that X number of results have been removed to comply with local law and we also report those removals to chillingeffects.org, a project run by the Berkman Center for Internet and Society, which tracks online restrictions on speech.

Platforms that host content like Blogger, YouTube, and Picasa Web Albums have content policies that outline what is, and is not, permissible on those sites. A good example of content we do not allow is hate speech. Our enforcement of these policies results in the removal of more content from our hosted content platforms than we remove from Google Search. Blogger, as a pure platform for expression, is among the most open of our services, allowing for example legal pornography, as long as it complies with the Blogger Content Policy. YouTube, as a community intended to permit sharing, comments, and other user-to-user interactions, has its Community Guidelines that define its own rules of the road. For example, pornography is absolutely not allowed on YouTube.

We try to make it as easy as possible for users to flag content that violates our policies. Here’s a video explaining how flagging works on YouTube. We review flagged content across all our products 24 hours a day, seven days a week to remove offending content from our sites. And if there are local laws where we do business that prohibit content that would otherwise be allowed, we restrict access to that content only in the country that prohibits it. For example, in Turkey, videos that insult the founder of modern Turkey, Mustafa Ataturk, are illegal. Two years ago, we were notified of such content on YouTube and blocked those videos in Turkey that violated local law. A Turkish court subsequently demanded that we block them globally, which we refused to do, arguing that Turkish law cannot apply outside Turkey. As a result YouTube has been blocked there.

Finally, our ads products have the most restrictive policies, because they are commercial products intended to generate revenue.

These policies are always evolving. Decisions to allow, restrict or remove content from our services and products often require difficult judgment calls. We have spirited debates about the right course of action, whether it’s about our own content policies or the extent to which we resist a government request. In the end, we rely on the principles that sit at the heart of everything we do.

We’ve said them before, but in these particularly challenging times, they bear repeating: We have a bias in favor of people's right to free expression. We are driven by a belief that more information means more choice, more freedom and ultimately more power for the individual.

Our stand for digital due process

The year was 1986. A gallon of gas cost 89 cents, Paul Simon’s Graceland won the Grammy for album of the year, and the federal Electronic Communications Privacy Act (ECPA), which governs how law enforcement can access electronic data, was signed into law.

A lot has changed since 1986. Gas is now measured in dollars and Taylor Swift (born 1989) won album of the year. All the while, technology has moved at record pace. But ECPA has stayed the same. Originally designed to protect us from unwarranted government intrusion while ensuring that law enforcement had the tools necessary to protect public safety, it was written long before most people had heard of email, cell phones or the “cloud” — the term used for programs helping people store personal data like photos and documents online. As a result, ECPA has become outdated.

This is why we’re proud to help establish Digital Due Process, a coalition of technology companies, civil rights organizations and academics seeking to update ECPA to provide privacy protections to new and emerging technologies.

Specifically, we want to modernize ECPA in four ways:
  • Better protect your data stored online: The government must first get a search warrant before obtaining any private communications or documents stored online;
  • Better protect your location privacy: The government must first get a search warrant before it can track the location of your cell phone or other mobile communications device;
  • Better protect against monitoring of when and with whom you communicate: The government must demonstrate to a court that the data it seeks is relevant and material to a criminal investigation before monitoring when and with whom you communicate using email, instant messaging, text messaging, the telephone, etc.; and
  • Better protect against bulk data requests: The government must demonstrate to a court that the information it seeks is needed for a criminal investigation before it can obtain data about an entire class of users.

1986 was a good year, but it’s time our laws catch up with how we live our lives today.

A new approach to China: an update

On January 12, we announced on this blog that Google and more than twenty other U.S. companies had been the victims of a sophisticated cyber attack originating from China, and that during our investigation into these attacks we had uncovered evidence to suggest that the Gmail accounts of dozens of human rights activists connected with China were being routinely accessed by third parties, most likely via phishing scams or malware placed on their computers. We also made clear that these attacks and the surveillance they uncovered—combined with attempts over the last year to further limit free speech on the web in China including the persistent blocking of websites such as Facebook, Twitter, YouTube, Google Docs and Blogger—had led us to conclude that we could no longer continue censoring our results on Google.cn.

So earlier today we stopped censoring our search services—Google Search, Google News, and Google Images—on Google.cn. Users visiting Google.cn are now being redirected to Google.com.hk, where we are offering uncensored search in simplified Chinese, specifically designed for users in mainland China and delivered via our servers in Hong Kong. Users in Hong Kong will continue to receive their existing uncensored, traditional Chinese service, also from Google.com.hk. Due to the increased load on our Hong Kong servers and the complicated nature of these changes, users may see some slowdown in service or find some products temporarily inaccessible as we switch everything over.

Figuring out how to make good on our promise to stop censoring search on Google.cn has been hard. We want as many people in the world as possible to have access to our services, including users in mainland China, yet the Chinese government has been crystal clear throughout our discussions that self-censorship is a non-negotiable legal requirement. We believe this new approach of providing uncensored search in simplified Chinese from Google.com.hk is a sensible solution to the challenges we've faced—it's entirely legal and will meaningfully increase access to information for people in China. We very much hope that the Chinese government respects our decision, though we are well aware that it could at any time block access to our services. We will therefore be carefully monitoring access issues, and have created this new web page, which we will update regularly each day, so that everyone can see which Google services are available in China.

In terms of Google's wider business operations, we intend to continue R&D work in China and also to maintain a sales presence there, though the size of the sales team will obviously be partially dependent on the ability of mainland Chinese users to access Google.com.hk. Finally, we would like to make clear that all these decisions have been driven and implemented by our executives in the United States, and that none of our employees in China can, or should, be held responsible for them. Despite all the uncertainty and difficulties they have faced since we made our announcement in January, they have continued to focus on serving our Chinese users and customers. We are immensely proud of them.

Let the Sunshine in

Public=Online is the the rallying cry during this year’s Sunshine Week, an annual event to highlight the importance of open government and the freedom of information. The week is sponsored by the American Society of News Editors, and many editorial boards have echoed the thoughts of the Cleveland Plain Dealer:
“...government information ought to be made available to the public as quickly as possible, with a minimum of rigmarole and in the easiest, most accessible way possible--which these days means via the Internet.”
We agree--and what better way to celebrate Sunshine Week than with leading thinkers on government, media and citizen engagement on all sides of the political spectrum who feel the same? Yesterday at our Google D.C. office, the Sunlight Foundation announced its Public=Online campaign.

It’s exciting to see growing support for transparency and to see the progress that’s been made in the last year alone. Every day, through sites like Data.gov and projects like Open Congress, OMB Watch and our Public Data Explorer, more data is available online.

But there’s still a gap between having access to government data and easily understanding what it means. To help fill this gap, Google has partnered with the Sunlight Foundation in its Design for America contest to make government data more comprehensible to the public.

A broadband catapult for America

Power. Clean water. The Interstate highway system. It’s easy to forget that the advantages of modern American life result from basic infrastructure investments made by earlier generations.

Tomorrow the FCC will release a national broadband strategy. The plan will set goals for expanding broadband to unserved and under-served areas, promote greater speeds, and drive consumer demand. It will harness this communications technology to urgent national priorities, such as jobs, education, health, energy, and security. In short, the plan will lay the groundwork for investing in America’s future.

Yes, the Internet was invented in the United States. Yes, we once led the world in broadband development. But now, networks in many countries, from Western Europe to East Asia, are faster and more advanced than our own. Long after we recover from this recession, this broadband gap will be a dead weight on American businesses and workers, unless we act now.

As with the space race in the 1960s, America needs a national effort by our scientists, engineers, companies, educational institutions and government agencies. Just like that great national adventure, we need near-term and long-term goals.

Broadband is an essential input to expanding business, education, and healthcare opportunities everywhere. As soon as possible, we need to bring Internet access to every community, from rural America to the inner cities.

But we also need even more ambitious objectives — or “stretch goals” — that test the limits of our ingenuity. When President John F. Kennedy summoned the nation to space exploration, the immediate goal was to send an astronaut in orbit around the earth. But JFK called for “putting a man on the moon” because he knew that dream would inspire Americans to literally reach for the stars.

The private sector has a big job to do, and needs to carry much of the investment. For our part, we plan to build and test an ultra-high-speed broadband network in at least one U.S. community. We are excited by the amount of support our proposed testbed has received from local communities and individuals.

But smart, tailored public policies are critical too. Let’s install broadband fiber as part of every federally-funded infrastructure project, from highways to mass transit. And let’s deploy broadband fiber to every library, school, community health center, and public housing facility in the U.S.

I support a national broadband strategy because ubiquitous broadband connectivity can catapult America into the next level of economic competitiveness, worker productivity, and educational opportunity. But as in the past, we will make this breakthrough by choice, not chance.

Recognizing courage, securing online freedom

More than ever, governments around the world are threatening online free expression. Forty countries have taken measures to limit this freedom, up from only a handful a few years ago. Google and YouTube services are or have been blocked in 25 of those nations.

On Thursday night in Paris, we took an important step to highlight this crucial issue by sponsoring the first Netizen Prize (or more elegantly, “Le Prix de Net Citoyen”) awarded by the Paris-based advocacy group Reporters Without Borders. And on Friday, March 12, we’ll be helping highlight the fight for Internet freedom by marking the group’s World Day Against Cyber Censorship on YouTube.

Fittingly, Reporters Without Borders chose to give the first Netizen Prize to the Iranian creators of the website Change for Equality, first established in 2006 to fight for changes in laws in Tehran that discriminate against women. That site has since become a well-known source of information on women’s rights in Iran, documenting arrests of women activists and becoming a rallying point for opponents of the regime.

Over the past year those leaders in Tehran have distinguished themselves — and earned the opprobrium of people all over the world — for their brutal crackdown on the rights of its critics to question their rule. Last year's killing of unarmed Neda Agha-Soltan during post-election protests in Tehran, seen around the world on amateur video, has become a symbol of the regime's ferocity — and the power of the Internet to reveal what governments do not want the world to see.

At the award ceremony in our Paris office, our Senior Vice President David Drummond said that we are at a critical point in the future of the Internet: "All of us have a choice. We can allow repressive policies to take flight and spread across the globe, or we can work together against such challenges and uphold the fundamental human right to free expression.”

David went on to praise the role of NGOs like Reporters Without Borders, the Obama Administration’s commitment to the promotion of Internet freedom and the efforts of all groups that have joined the Global Network Initiative. Under the initiative, major U.S. Internet companies, human rights group, socially responsive investors and academic institutions agreed to guidelines promoting free expression and protecting the privacy of their users around the world. “In the spirit of the undiplomatic American come to European shores," he said, "let me make a plea for European governments, companies and groups to rise to the occasion. Any effort that is limited to the United States is bound to fall far short of its global potential.”

A new approach to China

Like many other well-known organizations, we face cyber attacks of varying degrees on a regular basis. In mid-December, we detected a highly sophisticated and targeted attack on our corporate infrastructure originating from China that resulted in the theft of intellectual property from Google. However, it soon became clear that what at first appeared to be solely a security incident--albeit a significant one--was something quite different.

First, this attack was not just on Google. As part of our investigation we have discovered that at least twenty other large companies from a wide range of businesses--including the Internet, finance, technology, media and chemical sectors--have been similarly targeted. We are currently in the process of notifying those companies, and we are also working with the relevant U.S. authorities.

Second, we have evidence to suggest that a primary goal of the attackers was accessing the Gmail accounts of Chinese human rights activists. Based on our investigation to date we believe their attack did not achieve that objective. Only two Gmail accounts appear to have been accessed, and that activity was limited to account information (such as the date the account was created) and subject line, rather than the content of emails themselves.

Third, as part of this investigation but independent of the attack on Google, we have discovered that the accounts of dozens of U.S.-, China- and Europe-based Gmail users who are advocates of human rights in China appear to have been routinely accessed by third parties. These accounts have not been accessed through any security breach at Google, but most likely via phishing scams or malware placed on the users' computers.

We have already used information gained from this attack to make infrastructure and architectural improvements that enhance security for Google and for our users. In terms of individual users, we would advise people to deploy reputable anti-virus and anti-spyware programs on their computers, to install patches for their operating systems and to update their web browsers. Always be cautious when clicking on links appearing in instant messages and emails, or when asked to share personal information like passwords online. We have taken the unusual step of sharing information about these attacks with a broad audience not just because of the security and human rights implications of what we have unearthed, but also because this information goes to the heart of a much bigger global debate about freedom of speech. In the last two decades, China's economic reform programs and its citizens' entrepreneurial flair have lifted hundreds of millions of Chinese people out of poverty. Indeed, this great nation is at the heart of much economic progress and development in the world today.

We launched Google.cn in January 2006 in the belief that the benefits of increased access to information for people in China and a more open Internet outweighed our discomfort in agreeing to censor some results. At the time we made clear that "we will carefully monitor conditions in China, including new laws and other restrictions on our services. If we determine that we are unable to achieve the objectives outlined we will not hesitate to reconsider our approach to China."

These attacks and the surveillance they have uncovered--combined with the attempts over the past year to further limit free speech on the web--have led us to conclude that we should review the feasibility of our business operations in China. We have decided we are no longer willing to continue censoring our results on Google.cn, and so over the next few weeks we will be discussing with the Chinese government the basis on which we could operate an unfiltered search engine within the law, if at all. We recognize that this may well mean having to shut down Google.cn, and potentially our offices in China.

The decision to review our business operations in China has been incredibly hard, and we know that it will have potentially far-reaching consequences. We want to make clear that this move was driven by our executives in the United States, without the knowledge or involvement of our employees in China who have worked incredibly hard to make Google.cn the success it is today. We are committed to working responsibly to resolve the very difficult issues raised.
